1. Acceptance of Terms
By creating an account, using our website, or integrating with our marketing tools (including Google, Meta, or TikTok), you accept these Terms and Conditions and our Privacy Policy. You must be at least 18 years old and have the authority to bind your business to these terms.
2. Service Description
Go-Duka provides e-commerce and online store solutions, including storefront hosting, product management, payments, and marketing integrations. We integrate with Google (e.g., Shopping Ads, Analytics), Meta (Facebook and Instagram Marketing API), and TikTok (TikTok for Developers API) to help you manage campaigns and content. The availability of specific features may vary and is subject to third-party terms and our own policies.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and notify us of any unauthorized use. We may suspend or terminate accounts that violate these terms or applicable law.
4. Third-Party Services (Google, Meta, TikTok)
Use of Google, Meta (Facebook/Instagram), or TikTok features through Go-Duka is subject to the respective provider's terms and policies:
- Google: Google API Terms of Service and Google's Privacy Policy apply to Google integrations.
- Meta: Meta's Terms of Service, Commercial Terms, and Data Use policies apply to Facebook and Instagram integrations.
- TikTok: TikTok's Developer Terms of Service and Community Guidelines apply to TikTok integrations. See Section 5 for additional TikTok-specific terms.
Go-Duka acts as an intermediary: we facilitate your connection to these services but are not responsible for the actions, policies, or availability of Google, Meta, or TikTok. Any dispute with a third-party provider should be directed to that provider.
5. TikTok Integration Terms
By using TikTok integration features in Go-Duka, you agree to:
- Comply with TikTok's Developer Terms of Service
- Comply with TikTok's Community Guidelines and applicable TikTok policies
- Authorize Go-Duka to act as an intermediary for TikTok API access for the purposes you configure (e.g., marketing, content posting, analytics)
- Ensure all content posted to TikTok through Go-Duka complies with TikTok's policies and applicable law
Go-Duka is not responsible for TikTok's actions, policies, or service availability. Any disputes with TikTok should be directed to TikTok support. You may revoke TikTok access at any time through your Go-Duka account settings or through TikTok; doing so will disable TikTok-related features in your Go-Duka account.
6. Intellectual Property
Go-Duka and its branding, software, and content are owned by us or our licensors. You retain ownership of your business data and content. By using our services, you grant us a limited license to use your content and data as necessary to provide and improve our services and to operate integrations (e.g., syncing with Google, Meta, TikTok) as you have configured.
7. Limitation of Liability
To the maximum extent permitted by law, Go-Duka and Bunika Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities. Our total liability for any claims arising from these terms or your use of the services shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We do not guarantee uninterrupted or error-free operation of third-party integrations (Google, Meta, TikTok).
8. Governing Law
These terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise required by mandatory law.
9. Changes to Terms
We may update these Terms and Conditions from time to time. We will post the updated version on this page and update the "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms. For material changes, we may provide additional notice (e.g., by email or in-product notice).
